Yes – in most parts of Florida, kratom is legal for adults aged 21 and over. As of May 2025, the Florida Kratom Consumer Protection Act (FKCPA) regulates the sale of kratom products. However, Sarasota County enforces a local ban, where sale or possession of kratom is illegal and punishable by fines or jail time. We adhere to all state and local regulations and do not ship kratom outside Florida.
Under the FKCPA, it is illegal to “sell, deliver, barter, furnish or give” any kratom product to persons under 21. Customers buying kratom must present a valid government‑issued ID, similar to the requirements for alcohol and tobacco sales. For smoking accessories, we also require buyers to be at least 21 years old to comply with local laws.
Kratom is an herbal substance that can produce opioid‑ and stimulant‑like effects. U.S. and international agencies warn that kratom may cause serious harm and there are no uses approved by the U.S. Food and Drug Administration. The U.S. Drug Enforcement Administration lists it as a “drug and chemical of concern” because of its addictive nature. For hygiene, safety and legal reasons, consumable products (like kratom) and used smoking accessories cannot be returned or exchanged. Unused accessories in their original packaging may be eligible for exchange within 7 days of purchase with receipt. Gift sets can be exchanged only if all components remain unopened.
